Intellectual Property Policy

At SALS3.com, we are committed to respecting intellectual property rights and adhering to a thorough process for addressing intellectual property (IP) infringement claims. This policy outlines the procedures for submitting, investigating, and responding to IP infringement allegations. It covers copyright, trademark, patent, and other intellectual property rights protected under law.

1. Reporting Infringement

(1) To report an IP infringement, you must either be the rightful IP owner or have permission from the owner to act on their behalf.
(2) Upon receiving a valid report, we will investigate the content or listings in question. All reports must be submitted in good faith, and you are required to swear under penalty of perjury that the information provided is truthful.
(3) Reports must be submitted through our IP Portal. Please include the following details in your report:

  • Clear identification of the IP being infringed (e.g., registration number, a detailed description of the copyrighted work, link to the work, date of first use/publication).
  • A description of the infringement (whether on the product, packaging, product images, or text on the product page).
  • List of infringing products, with URLs to the product detail pages.
  • List of infringing parties.
  • Supporting evidence or documentation, such as order IDs for test purchases.
  • Your contact details (name, address, phone number, email).
  • Any other relevant information required by applicable laws.

(4) Additional information may be requested to verify ownership or provide supporting documentation.

2. Reporting Copyright Infringement under IP Laws

(1) If you are a copyright holder or an authorized representative, you can submit a notice of copyright infringement through the IP Portal, which should include the following:

  • The signature of the authorized person acting on behalf of the copyright holder.
  • A list of the copyrighted works allegedly infringed, which may include multiple works.
  • Identification of the infringing material to be removed or disabled, with enough information to locate it.
  • Contact information, including address, phone number, and email.
  • A statement of good faith belief that the use of the material is unauthorized.
  • A representation that the information provided is accurate and that the submitter is the copyright holder or authorized representative, sworn under penalty of perjury.

(2) Misrepresentation of infringement can lead to liability for damages. If you're unsure about infringement, seek legal advice before submitting a notice.
(3) Once we accept a valid infringement notice, we will remove the infringing content and take appropriate action. We do not disclose any actions that are not publicly available.
(4) Repeat Infringer Policy: We take intellectual property rights seriously and may terminate the accounts of repeat infringers where necessary.

3. Counter-Notice for Copyright Infringement Claims

(1) If the content provider believes their material was removed by mistake, they can submit a counter-notice that includes:

  • A statement explaining why the material was wrongly removed or misidentified.
  • Any additional information required by applicable laws.

(2) If a counter-notice is submitted, we will take the necessary legal steps in accordance with applicable laws.

4. Withdrawal of Report

The IP owner or authorized agent who submitted an infringement report may withdraw it via the IP Portal. The withdrawal request must include:

  • The identity of the reporting party.
  • The intellectual property rights originally reported as infringed.
  • The materials being withdrawn from the complaint.

5. False Notices

(1) We may reject reports of infringement that contain false, misleading, or incomplete information, or those made in bad faith. We also reserve the right to take action against individuals abusing this policy or the law.
(2) Repeated submission of false or incorrect notices may lead to the loss of reporting privileges.
